Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") form a legally binding agreement between you and PJMATCH.COM ("PJmatch," "we," "us," or "our"), a dating platform operated from Rockford, Illinois. By accessing, registering for, or using PJmatch — including the website, mobile experience, Singles Lounge, events, chat, and email features (collectively, the "Service") — you agree to be bound by these Terms, our Privacy Policy, our Community Guidelines, and our Disclaimer. If you do not agree with any of these Terms, do not use the Service.

2. Eligibility

You must be at least 18 years old to use PJmatch. By creating an account, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into these Terms; (c) you have never been convicted of a felony, a sex crime, or any crime involving violence, and you are not required to register as a sex offender with any state, federal, or local sex offender registry; and (d) all information you provide is truthful and accurate. We may terminate any account at any time if we believe these representations are untrue.

3. The Service

PJmatch is an online venue that allows adults to create profiles, search for and communicate with other members, join community chat rooms, and create or RSVP to local events. PJmatch is a neutral venue. We do not arrange, broker, supervise, or participate in any meeting, date, event, or interaction between members. What happens between you and another member — online or offline — is solely between you and that member.

4. No Background Checks — You Are Responsible for Your Safety

PJmatch does not currently conduct criminal background checks, sex-offender registry checks, identity verification, or other screenings of its members, and we make no representation that any member has been screened. We may (but are not obligated to) conduct screenings or verify information at any time. Any badge, including the "Founding Member" badge, reflects only when a member joined — it is not a verification of identity, character, or trustworthiness.

You are solely responsible for your interactions with other members, both online and in person. Before meeting anyone in person, review our Safety Guide: always meet in a public place, tell a friend or family member your plans, arrange your own transportation, and never send money or share financial information with someone you met online.

5. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

6. User Conduct

You agree that you will not:

• Harass, threaten, stalk, defraud, or harm any member;
• Solicit money, gifts, or financial information from other members;
• Impersonate any person, or misrepresent your identity, age, or relationship status;
• Use the Service for any commercial purpose, including advertising, recruiting, or prostitution;
• Post illegal, obscene, abusive, defamatory, or otherwise objectionable content;
• Scrape, data-mine, or collect member information by automated means;
• Use the Service if you are under 18 or are a registered sex offender.

7. User Content

You retain ownership of the content you post (photos, text, event listings, and other materials). By posting content, you grant PJmatch a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely in connection with operating and promoting the Service. You represent that you own or control all rights to the content you post and that your content does not infringe any third party's rights. 8. No Endorsement of Members or Content

Opinions, statements, profiles, photos, event listings, and other content posted by members are those of the member alone and do not reflect the views of PJmatch. We do not endorse, verify, or guarantee the accuracy, completeness, or truthfulness of any member profile, message, or event listing, and we are not responsible for the conduct of any member.

9. Member-Organized Events

Events listed on PJmatch are created and hosted by members, not by PJmatch, unless expressly stated. PJmatch does not organize, supervise, insure, or control member events and makes no representation about their safety, legality, or suitability. You attend any event at your own risk. Event organizers are solely responsible for their events, including compliance with applicable laws and venue rules.

10. Communications Features

PJmatch provides real-time chat, an internal email system, and a community Singles Lounge. Messages between members are private to those members, but you should have no expectation of absolute privacy: we may access, review, or disclose communications as described in our Privacy Policy — for example, to investigate reports, enforce these Terms, respond to legal process, or protect the safety of members. Do not share content through the Service that you are not prepared to have reviewed in those circumstances.

11. Moderation, Reporting, and Enforcement

We may (but are not obligated to) monitor the Service, review reports, and remove content or suspend accounts at our sole discretion, with or without notice. Our decision to act — or not to act — in any given case does not create any duty or liability on our part. If you have a dangerous encounter with a member, contact local law enforcement first, then report the member to us.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including conduct we believe violates these Terms or is harmful to other members or to us. You may delete your account at any time through your settings. Provisions that by their nature should survive termination (including Sections 13–18) survive.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. PJMATCH EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, PJMATCH MAKES NO REPRESENTATION OR WARRANTY THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY MEMBER PROFILE, IDENTITY, AGE, PHOTO, OR STATEMENT IS ACCURATE OR TRUTHFUL; (C) ANY MEMBER HAS BEEN SCREENED; (D) YOU WILL FIND A MATCH OR ANY PARTICULAR RESULT FROM USING THE SERVICE; OR (E) ANY MEMBER-ORGANIZED EVENT WILL BE SAFE, LAWFUL, OR AS DESCRIBED.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL PJMATCH, ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) THE CONDUCT, ACTS, OR OMISSIONS OF ANY MEMBER OR THIRD PARTY, WHETHER ONLINE OR OFFLINE, INCLUDING ANY MEETING, DATE, EVENT, RELATIONSHIP, HARASSMENT, ASSAULT, FRAUD, THEFT, EMOTIONAL DISTRESS, PERSONAL INJURY, OR DEATH ARISING FROM OR RELATED TO INTERACTIONS BETWEEN MEMBERS; (C) ANY CONTENT POSTED BY ANY MEMBER; OR (D) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT OR ACCOUNT.

TO THE FULLEST EXTENT PERMITTED BY LAW, PJMATCH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). BECAUSE THE SERVICE IS CURRENTLY FREE, MOST USERS WILL HAVE PAID NOTHING.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless PJmatch and its owners, operators, officers, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your content; (c) your violation of these Terms or of any law or third-party right; or (d) your interactions with any other member, including any event you organize or attend.

16. Dispute Resolution — Binding Arbitration and Class Action Waiver

Informal resolution first. Before filing any claim, you agree to contact us through our Contact page and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration. EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT OR SEEK INJUNCTIVE RELIEF FOR INTELLECTUAL PROPERTY MISUSE, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS CONSUMER ARBITRATION RULES. THE ARBITRATION WILL TAKE PLACE IN WINNEBAGO COUNTY, ILLINOIS, OR BY VIDEO OR TELEPHONE AT YOUR ELECTION. THE ARBITRATOR — NOT ANY COURT — HAS EXCLUSIVE AUTHORITY TO RESOLVE DISPUTES ABOUT THE SCOPE AND ENFORCEABILITY OF THIS ARBITRATION PROVISION.

Class action and jury waiver. YOU AND PJMATCH EACH AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND PJMATCH EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

Opt-out. You may opt out of this arbitration agreement by sending us written notice within 30 days of first creating your account, stating your name, username, and email address and your intent to opt out, through our Contact page.

17. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws principles. To the extent any dispute is not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Winnebago County, Illinois.

18. General

Changes. We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date, and material changes will be announced through the Service. Your continued use after changes take effect constitutes acceptance.

Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force, except that if the class action waiver is held unenforceable, the entire arbitration provision (but not the rest of these Terms) is void.

No waiver. Our failure to enforce any provision is not a waiver of that provision. Entire agreement. These Terms, together with the Privacy Policy, Community Guidelines, and Disclaimer, are the entire agreement between you and PJmatch regarding the Service.
